1. Agreement to Terms

This User Agreement ("Agreement") governs your access to and use of SMMMerc, available at https://smmmerc.com ("Platform").

By registering an account, adding funds, placing an order, accessing our API, or otherwise using the Platform, you agree to this Agreement and our Privacy Policy and Refund Policy.

If you do not agree to these terms, you must discontinue using the Platform.

2. Our Services

SMMMerc provides access to social media marketing services, which may include followers, likes, views, comments, subscribers, shares, and other promotional services for supported platforms.

Available services, prices, delivery estimates, refill eligibility, cancellation options, and other conditions are displayed in the service listing or communicated through the Platform.

Service availability and specifications may change over time.

3. Eligibility and Account Registration

You must be legally permitted to use the Platform under the laws applicable to you and meet the minimum age requirements applicable to your use.

You agree to provide accurate registration information and keep your account details up to date.

You are responsible for:

• Maintaining the confidentiality of your login credentials.
• Securing access to your account.
• All activity carried out through your account, subject to applicable law.
• Notifying us promptly if you suspect unauthorized access.

Do not share your password or account credentials with unauthorized parties.

4. Account Balance and Payments

SMMMerc may allow users to deposit funds using the payment methods displayed on the Platform.

You agree that:

• You will use payment methods you are authorized to use.
• Deposits must comply with the requirements of the applicable payment provider.
• Orders will be charged according to the displayed service price and order quantity.
• Additional payment-provider fees or currency conversion charges may apply where disclosed by the provider.
• Your account balance and transaction history should be reviewed regularly.

Funds added to your account are intended for use on the Platform and are subject to the Refund Policy, applicable payment rules, and mandatory consumer rights.

You must not use payments, chargebacks, or deposits to facilitate fraud or unauthorized transactions.

5. Placing Orders

Before submitting an order, you are responsible for checking:

• The selected service and service ID.
• The target profile, post, video, channel, or other URL.
• The requested quantity.
• The service speed, start-time estimate, and delivery conditions.
• Refill, cancellation, and drop-related terms.
• Any eligibility requirements stated in the service description.

Once submitted, an order may enter processing automatically or through our service providers.

Incorrect links, unsupported targets, private content, deleted content, or other conditions outside the service specifications may prevent successful delivery.

6. Delivery, Speed, and Completion

Delivery speeds and start times are estimates unless a specific guarantee is expressly stated in the service description.

Orders may start immediately or after a processing period. Completion times can vary depending on service capacity, platform conditions, supplier availability, and order quantity.

An order marked as completed indicates that the applicable service provider or system has reported completion under its service criteria. It does not guarantee permanent retention, a particular business result, or a specific increase in sales or revenue.

7. Drops and Refill Services

Some social media services may experience a reduction in delivered followers, likes, subscribers, or other engagement. This is commonly referred to as a "drop."

Where a service includes a refill feature, the applicable refill duration, eligibility conditions, and procedure will be stated in its description.

Refill availability does not mean that permanent retention is guaranteed. Users must follow the stated refill procedure and submit eligible requests within the applicable period.

Services without a refill guarantee are not covered by refill commitments unless otherwise stated.

8. Cancellations and Partial Refunds

Cancellation availability depends on the order status and the selected service.

Where supported, cancellation or refill buttons may be available in the order interface. Submitting a request does not guarantee that an order can be stopped if processing or delivery has already occurred.

If an order cannot be fulfilled or is only partially delivered, the applicable resolution will be determined in accordance with our Refund Policy and the service conditions.

9. API and Reseller Use

SMMMerc may provide API functionality for eligible users, resellers, and third-party panels.

API users are responsible for:

• Keeping API keys confidential.
• Using the API according to the published technical documentation and applicable limits.
• Protecting their own customers' data and account credentials.
• Accurately representing service descriptions, pricing, delivery estimates, and refill terms to their customers.
• Ensuring that their own business activities comply with applicable laws and third-party platform requirements.

You must not abuse the API, bypass security controls, overload systems, or use the API for unlawful purposes.

SMMMerc may restrict API access where necessary to protect the Platform, investigate suspected abuse, or maintain service stability.

10. Acceptable Use

You agree not to use the Platform to:

• Commit fraud or engage in unlawful activity.
• Impersonate another person or misrepresent your authority.
• Violate intellectual property, privacy, or other legal rights.
• Distribute malicious software or attempt unauthorized system access.
• Interfere with the operation or security of the Platform.
• Circumvent service restrictions, payment controls, or API limits.
• Use services in a manner prohibited by applicable law.

You are responsible for ensuring that your intended use complies with the rules and requirements applicable to you.

11. Third-Party Social Media Platforms

SMMMerc is an independent service provider and is not affiliated with, endorsed by, or officially connected to Instagram, Facebook, YouTube, TikTok, X, Telegram, or other third-party platforms unless expressly stated.

Third-party platforms may change their policies, algorithms, technical systems, or enforcement practices at any time.

We cannot guarantee that using a particular service will be permitted by a third-party platform or will prevent account restrictions, content removal, or other platform actions.

You are responsible for reviewing the relevant third-party terms and deciding whether to use a service.

12. Service Availability and Modifications

We may update, suspend, replace, or discontinue services, pricing, or features when reasonably necessary for operational, security, supplier, or legal reasons.

We will handle affected orders in accordance with the applicable service terms, Refund Policy, and mandatory legal requirements.

We aim to maintain reliable access but cannot guarantee uninterrupted or error-free operation.

13. Suspension and Account Termination

We may investigate, restrict, suspend, or terminate accounts where reasonably necessary to address suspected fraud, security risks, unlawful activity, misuse of the Platform, or material violations of this Agreement.

Where appropriate and legally permitted, we may notify the user and provide an opportunity to resolve the issue.

Any outstanding orders and account balances will be handled in accordance with applicable law and our published policies. Nothing in this Agreement excludes rights that cannot legally be waived.

14. Disclaimers and Limitation of Liability

To the extent permitted by applicable law, the Platform and its services are provided subject to the specifications and limitations stated for each service.

We do not guarantee specific business outcomes, audience engagement, revenue, rankings, or permanent retention unless expressly stated in an applicable service commitment.

Nothing in this Agreement excludes or limits liability where such exclusion or limitation is prohibited by law.

To the extent legally permitted, SMMMerc will not be liable for indirect or consequential losses arising from circumstances beyond its reasonable control. Any other limitations of liability will apply only to the extent permitted by applicable law.

15. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims arising from your unlawful use of the Platform, your violation of this Agreement, or your infringement of third-party rights.

Nothing in this section removes any rights or obligations that cannot legally be excluded.

16. Governing Law and Disputes

This Agreement is subject to the applicable laws governing the operator of SMMMerc, without removing any mandatory rights that apply to users under the laws of their country or region.

If a dispute arises, please contact our support team first so that we can attempt to resolve it.

Any formal dispute will be handled by the competent authority or court as required by applicable law.

Before publication: Insert the legal name and jurisdiction of the actual business operator where required.

17. Changes to This Agreement

We may revise this Agreement from time to time. Updated terms will be published on this page with a revised date.

Continued use of the Platform after changes take effect will be subject to the revised terms to the extent permitted by applicable law.
